These Terms and Conditions ("Terms") govern your use of inDepth Apnea Sync (the mobile app), inDepth Apnea Blue and inDepth Apnea Pool (the Garmin Connect IQ watch apps), the inDepth desktop installer, and this website — together, the "Software". The Software is made by Mariusz Kociubinski ("we", "us", "our").
1. Agreement to these Terms
By installing or using any part of the Software you agree to these Terms. If you do not agree with them, do not use the Software. If you obtained the Software through the Apple App Store or Google Play, the terms of those stores also apply to your download and installation.
2. Safety — read this section
Freediving and breath-hold training can cause loss of consciousness, drowning and death. Shallow-water blackout is silent and gives no warning. Never freedive or practise apnea alone, in open water or in a swimming pool. Always train with a trained buddy who is watching you directly and is able to rescue you, and follow the one-up-one-down rule.
The Software is not a dive computer. It is a training aid and a logbook. It does not perform decompression calculations, does not plan dives, and is not a substitute for training, supervision, judgement or a certified dive computer.
The Software is not a medical device and provides no medical advice, diagnosis or treatment. Heart rate, surface interval, depth and any other figure it displays are informational only. Consult a doctor before beginning breath-hold training, and get proper instruction from a recognised freediving agency.
Rest and recovery figures are minimums, not clearances. The surface-rest models the Software implements are simplified public models. A completed rest timer means only that a chosen model's minimum interval has elapsed — it is never a determination that it is safe for you to dive again. That judgement is always yours and your buddy's.
Alarms and alerts can fail. Depth alarms, rest alerts and any other notification depend on your watch's sensors, battery, firmware and settings, and on the Software itself, none of which are guaranteed to work. Never rely on the Software as your only safety mechanism.
Measurements are approximate. Depth is derived from the watch's barometric pressure sensor. On some Garmin models the firmware limits the depth range reported to Connect IQ apps, so recorded depths may be capped, delayed or inaccurate. Times, distances and heart rates are similarly subject to sensor error.
3. Assumption of risk
You use the Software entirely at your own risk, and you are solely responsible for every decision you make about diving, training and your own safety. You accept the inherent risks of freediving, spearfishing and breath-hold training. To the fullest extent permitted by law, you agree that we are not liable for any injury, death, illness, loss or damage arising from your use of, or reliance on, the Software.
4. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on devices you own or control, for your own non-commercial use. You may not sell, rent, sublicense or redistribute the Software, and you may not reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits despite this restriction.
5. Your data and your devices
The Software stores your dive data on your own watch and phone. We operate no server, hold no copy of your data, and cannot recover it for you. Backing up your data is your responsibility — the app provides a backup export for that purpose. We are not liable for lost dive records, whatever the cause, including device loss or failure, a failed sync, an app or operating-system update, uninstalling the app, or the watch's rolling session buffer overwriting sessions you had not yet transferred.

6. Price and availability
The Software is currently provided free of charge. It contains no advertising and no in-app purchases. We may change, suspend or discontinue any part of the Software, or stop supporting any device, at any time and without notice.
7. No warranty
The Software is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Software will be uninterrupted, error-free, accurate, or compatible with any particular device or firmware version. Some jurisdictions do not allow the exclusion of implied warranties, in which case the exclusions above apply only to the extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Software. This limitation applies regardless of the legal theory advanced and even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
9. Support
inDepth is made by one person. We will try to help with problems and read everything sent to us, but we do not commit to any response time, to fixing any particular issue, or to providing support indefinitely. See the Support page.
10. Intellectual property and trademarks
The Software, its source code, name, logo and original content remain our property and are protected by copyright and trademark law. Your licence to use the Software grants you no ownership in it.
Garmin, Fēnix, Descent and Connect IQ are trademarks of Garmin Ltd. or its subsidiaries. Apple and App Store are trademarks of Apple Inc. Google Play is a trademark of Google LLC. AIDA and Molchanovs are trademarks of their respective organisations, referred to here only to identify the publicly documented training models the Software implements. inDepth is an independent project and is not affiliated with, endorsed by, sponsored by or certified by any of them.
11. Changes to these Terms
We may modify these Terms at any time. The current version is always the one posted at this URL, with its "last updated" date at the top. Continuing to use the Software after a change means you accept the revised Terms.
12. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
